As state postconviction motions mostly entail inquiry into effectiveness of trial or appellate counsel, the record and appellate briefs are essential, as are the trial-, plea- and/or sentencing transcripts. Federal habeas corpus petitions under 28 U.S.C. § 2254 also require copies of state postconviction motions, responses and rulings. Federal postconviction motions pursuant to 28 U.S.C. § 2255 require copies of the judgment and sentence, the trial-, plea- and/or sentencing transcript, as well as a variety of other documents, depending upon the type of prosecution. Newly-discovered evidence claims require additional fact investigation. Postconviction motions have strict limitations begging to be overcome.
